Thunderclap Local Licence

This licence is an agreement between you and B-Side Tech Limited, 1004 Lock Apartments, 21 Gillender Street, London E3 3YH, United Kingdom ("we", "us"), about Thunderclap Local (the "Software"): the Docker image and the software in it. If you accept it for an organisation, "you" means that organisation and everyone using the Software on its behalf. By downloading or running the Software, you accept this licence.

1. What you may do

We grant you a free, worldwide, non-exclusive, non-transferable and non-sublicensable licence to download and run the Software, unmodified, for development and testing: on developers' machines, in automated tests and in continuous integration, while you build or test software meant to use the Thunderclap managed service. Companies may use it on these terms at no cost. You may keep copies of the image in your own private registry or cache for these uses.

2. What you may not do

You may not:

For production, use the Thunderclap managed service under its Terms of Service.

3. Ownership

The Software is licensed, not sold. We and our licensors keep every right not expressly granted here, including all intellectual property in the Software. This licence gives you no right to use our names, logos or trademarks. The Thunderclap SDKs (@thunderclapjs/client and @thunderclapjs/server) are licensed separately, under the MIT licence.

4. Termination

This licence ends automatically if you breach it. When it ends, stop using the Software and delete your copies. We may publish new versions of this licence; each version of the Software is governed by the licence it ships with.

5. No warranty

The Software is provided "as is", without warranty of any kind, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. It is a development tool: it keeps no data, does not behave exactly like the managed service in every respect, and may change or stop being offered at any time.

6. Liability

To the extent the law allows, we are not liable for any loss or damage arising from the Software or this licence, whether in contract, tort (including negligence) or otherwise, including loss of profits, revenue, data or goodwill. Nothing in this licence limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

7. Law

This licence is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about it.
